Terms & Conditions

This document contains the terms and conditions relating to the reservation of a property to the Owner as defined below. In the event of any conflict between the terms below and the terms of the Contract, the terms of the Contract shall prevail.
Owner
The Owner designates the owner of the site Le Vieux Monastère located at 15 rue Saint martin 17770 St Hilaire de Villefranche (the “Property”).
Client
Client means the tenant of one or more of the 7 Gites and/or Common Areas located on the Property who has entered into a Rental Agreement with the Owner (the “Agreement”). Companions means the person(s) occupying the accommodation with the Client within the maximum capacity of each Gite rented.
Security deposit
The payment of the deposit must be included in the final balance or in case of reservation via a third party at the latest on the day of arrival (in this case in cash). This one will be cashed. The security deposit will be returned, minus any amounts, within 1 month of departure in accordance with the conditions of these rules.
Tourist tax
The Tourist Tax of 1.21 euro per adult per night must be paid at the same time as the payment of the balance of the Rental Contract or, subject to the agreement of the Owner, before the day of departure. Only cash payment will be accepted on the day of departure and the exact amount must be paid by the Client. It is the Client’s responsibility to declare the exact number of adults and children during the stay and the Client will be solely responsible for any failure to do so or for providing incorrect information.

Capacity
The maximum occupancy of the lodges listed below must not be exceeded, and infants and children must be included when indicating the number of Companions in the group. Customer may make a request to Owner for additional non-resident guests to be admitted. Acceptance of such a request is at the discretion of the Owner and may be subject to an additional fee. For the Common Areas, a maximum of 50 persons is allowed and may not be exceeded without the written consent of the Owner.

Insurance
The Client is strongly advised to purchase a comprehensive travel or resort insurance policy (including cancellation coverage) at the time of booking. This should include full coverage for the Client and his/her Companions. In the event of a reservation for all Gîtes, a certificate of insurance must be provided to the Owner.
Arrival and departure times
The rental period begins at 4:00 pm on the day of arrival and ends no later than 10:00 am on the day of departure unless otherwise agreed in writing by the Owner. Arrivals must be before 8pm and departures after 7am unless otherwise agreed by the Owner. The Client must notify the Owner at least 24 hours in advance of the planned departure and arrival times, it being understood that the Owner may impose an adjustment of the departure/arrival time in the event of multiple departures/arrivals at the same time. Any departure without verification of the inventory of fixtures with the Owner will give the Owner the right to carry out the inventory of fixtures alone and to deduct from the deposit any damage noted, without this releasing the Client from his responsibility in the event of damage exceeding the deposit.

The Gites refer to the following 7 Gites with their following maximum capacity. In no case a gite will be able to contain more than 15 persons:

The rest of the property is composed of private and common areas.
Common areas
The Common Parts are composed of:
- The pool
- The reception room
- The garden
- The playground
- The game room
- The entrance
- Garbage room
The Owner may restrict access to the Common Areas at any time without notice and at its sole discretion, in whole or in part, or subject to conditions (e.g., hours of access, or access to certain persons in the event of non-compliance with Common Area materials).
The Client shall clean and tidy the Common Areas after each use. Any items left in the Common Areas may be picked up by the Owner and returned upon request by the Client. The Client agrees not to bring any items from the Gîtes into the Common Areas other than plastic dishes.
For reservations that include all of the Gîtes, crockery dedicated to the Common Areas may be provided by the Owner upon request and subject to availability.
Private areas
All areas not included in the Common Areas or Gîtes constitute private areas for the exclusive use of the Owner. Access by the Client is strictly prohibited.
Subletting
Client is not permitted to sublet the Property.
Linen and cleaning products
Bedding and towels (one towel per person) will be provided at the beginning of occupancy if the option has been chosen by the Client. Towels must not be removed from the Property or the Gite at any time. If the Client requests a change of bed linen in the middle of the stay, a charge will be made.The use of towels in the pool is prohibited.
The Client can ask to have the household linen provided for his stay (sheets and/or towels). In this case, the linen will be made available to him in his Gite(s). If the Client requests to have the beds made up on arrival, he/she must make a prior request to the Owner, who may accept the request at his/her sole discretion, in which case additional charges may apply.The towels thus provided must not be used outside the Gite, nor even at the swimming pool.
At the end of the stay, all the household linen (except bed linen) must be put in front of the washing machine, sheets and towels separated in two distinct piles.Any stain or damage to the house linen must be reported to the Owner. Dry cleaning charges may apply. In case of discovery of unreported damage, the Owner may charge and/or deduct from the security deposit, the replacement costs of the damaged items, at their replacement value without taking into account any possible vetustation.
If the Customer has not subscribed to the linen option, the Customer is obliged to bring all the household linen for himself and his Companions, it is strictly forbidden to sleep on the sofas or on the beds without sheets.The rental does not include toiletries (soap etc.), cleaning products, dishwashing products or laundry which are the responsibility of the Customer;

During your stay photos or video may be taken by the video surveillance system for your safety and the integrity of the Property in the common areas. Unless there is a breach of this policy, or a request by the appropriate authorities, the recordings will be deleted within a reasonable time.
Photos and videos for commercial purposes (website, social networks, advertising etc.) may also be taken with your consent.

Garbage room
The garbage cans are located in front of the pool. Please make sure that all your waste is placed in appropriate trash bags brought by you (not supermarket carry bags) and securely tied before placing it in the trash cans. Recycling bags are available under the sink in your Gite. It is forbidden to put non-recyclable items in them. Also, glass waste (bottles etc.) must be taken to a container outside the Property. Please empty the cold ashes from the barbecue into your garbage bags.

The cleaning of the Gîtes rented by the Client is under his entire responsibility during the entire stay. The Client agrees to return the rented property in the same condition as he received it, including but not limited to cleaning the floors, kitchens (ovens, refrigerator, clean and tidy dishes, etc.), toilets and showers with appropriate products (bleach prohibited), mirrors and windows, emptied trash cans (even in the bathrooms), etc;
In case of option for the end of stay cleaning package, the Client will have to leave the place in a reasonable state. In all cases, any additional cleaning time required to restore the Gite in the event of non-compliance with the provisions of this article will be charged at 30€ per hour by the Owner in good faith;

In order to respect the environment, we ask our customers to respect the following measures.
Wastes
Waste must be sorted, it is the Customer’s responsibility to provide appropriate garbage bags for household waste, it is forbidden to throw away waste without bags, or in plastic/paper bags. Recyclable waste (cardboard, paper, packaging, plastics) must be placed in a yellow bag provided by the Owner and placed in the large container in the Garbage Room. Glass waste must be placed in a public container outside the Property.

Pests Insects/animals
A rural location inevitably means bugs from time to time. Following the rules of garbage disposal and not leaving food around will help keep bugs and other unwanted guests away! Keeping your windows open with the lights on will definitely attract insects including mosquitoes. We suggest that keeping windows open and shutters closed after dark is the best compromise between heat and insects.

Modifications
The invalidity of any provision hereof shall not automatically invalidate the remainder of the terms and conditions or the Rental Agreement. In the event of any conflict between the terms and conditions and the Rental Agreement, the terms of the Rental Agreement shall prevail unless otherwise expressly provided. The Owner reserves the right to update these terms and conditions at any time unilaterally without notice and the Customer agrees to check the terms and conditions during his stay.
Disclaimer
The use of the facilities of the site, including but not limited to the swimming pool, playgrounds, sports equipment etc., shall at all times be at the risk of the Client.
The Client accepts responsibility for the supervision of children at all times and agrees to check the integrity of the materials provided before each use (this also applies to the inventory items mentioned in paragraph 9 above).Owner shall not be liable to Customer for any failure or temporary stoppage in the supply of utilities to the Site or for the failure or temporary stoppage of any equipment, plant, machinery or apparatus in the Property or the Site Facilities.The Owner, however, shall use its best efforts to repair or replace any equipment, plant, machinery or apparatus which is found to be defective or temporarily out of order within a reasonable time.
The Owner shall not be liable to the Client for the theft or loss of any property, personal effects or vehicle of the Client or his companions during his stay, or for any damage caused to the Client or any member of the party (including non-resident guests where applicable) while using the Property, any part of the site or parking lot.
Booking Types
- Standard reservation: Standard terms and conditions for a reservation of one or more gites, for one or more nights.
- Daily: Reservation for one or more days, one or more gites without sleeping accommodation. Arrival and departure times are more flexible and determined with the Owner and events can be authorized with the Owner’s agreement in case of reservation of the whole site with access to the reception room.
- Group: Reservation of the entire site for use by a group for one or more nights. Arrival and departure times are more flexible and determined with the Owner and events can be authorized with the Owner’s approval with access to the reception room. 50 beds maximum.
- Large events: Same as group bookings, but it is possible to accommodate additional guests who do not stay overnight. Maximum 50 beds.
Major Forces
The owner will not be held responsible in case of impossibility to render all or part of the services due to an event of force majeure.
Additional Games
Additional games may be made available to the Client or his/her Companions by the Owner upon request and subject to availability. Any games borrowed during your stay including, but not limited to: ping pong, foosball, bocce, shuffleboard, molkee, darts, balls, rackets, etc. must be stored and used with care. Any damage caused by the Client or his/her companions to the Extra Games shall be compensated by the Client to the Owner.
